In 1882, Burgess gained admission to the bar, embarking on his legal career in La Grange, Texas. Eventually, he made his way to Gonzales in 1884. Serving as the prosecuting attorney of Gonzales County from 1886 to 1889, he later resigned from the position.

Burgess's political journey commenced when he successfully secured the Democratic nomination, earning the trust of the constituents to represent them in the Fifty-seventh Congress. Remarkably, he went on to serve in the following seven Congresses, diligently advocating for the interests of his district from March 4, 1901, to March 3, 1917. In 1916, he pursued the Democratic nomination for United States Senator, although his efforts did not result in victory. Returning to Gonzales, Texas, Burgess resumed his legal practice until his passing on December 31, 1919.
